These Terms govern your use of our website, the purchase of fitness equipment, and all associated services provided by Flexstorewn Equipment Ltd. These Terms apply to all customers, including consumers and businesses. By placing an order with us, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. User Eligibility

You represent and warrant that:

  • You are at least 18 years of age or have reached the age of legal majority in your jurisdiction;
  • You have the legal capacity to enter into binding contracts;
  • You are not prohibited by law or regulation from using our services;
  • Any information you provide is accurate, truthful, and complete.

3. Products and Services

Flexstorewn Equipment Ltd supplies professional fitness equipment and related services, including delivery, installation, and maintenance support. All product descriptions, images, and specifications on our website are provided for general information purposes and are subject to change without notice. We strive to ensure accuracy but do not guarantee that all product information is error-free.

3.1 Product Availability

Product availability is subject to stock. We reserve the right to discontinue products, modify specifications, and adjust pricing at any time. We are not responsible for typographical errors or omissions in product listings.

4. Ordering and Contract Formation

When you place an order through our website or by contacting us directly, you are making an offer to purchase products on these Terms. Your order is not binding until we confirm it in writing via email. We reserve the right to refuse or cancel any order without providing reason, particularly if:

  • The order contains inaccurate or incomplete information;
  • Payment is declined or fails;
  • We suspect fraud or unauthorised use;
  • The product is out of stock or unavailable;
  • Delivery to your location is not feasible.

5. Pricing and Payment

All prices are quoted in British Pounds (GBP) and are exclusive of VAT unless otherwise stated. VAT will be calculated and added at the applicable rate. Prices are subject to change without notice, but changes will not apply to confirmed orders. We accept payment via debit card, credit card, bank transfer, and other methods as indicated on our website. Payment must be received in full before we dispatch your order. All payment information is processed securely and subject to our Privacy Policy.

5.1 Invoicing

Invoices are issued upon order confirmation. For business customers with agreed payment terms, invoices are due within the agreed period or 30 days from invoice date, whichever is sooner. Late payment may incur interest charges at the rate of 8% per annum plus Bank of England base rate.

6. Delivery and Shipping

We arrange delivery of equipment through third-party logistics partners. Delivery timescales are estimates and not guaranteed. Delivery is arranged to a UK address unless otherwise agreed. Delivery charges are calculated based on postcode and product weight and will be confirmed before payment. Risk of loss or damage to products passes to you upon delivery.

6.1 Delivery Damage

Inspect all deliveries upon receipt. Any damage must be reported to us within 48 hours with photographic evidence. Claims for delivery damage must include proof of delivery and photos of damage. Failure to report damage within this timeframe may result in claims being rejected.

6.2 Non-Delivery

If a delivery is not received within a reasonable timeframe, contact us immediately. We will investigate with our courier partner. If the item is confirmed as lost, we will either arrange a replacement or provide a full refund.

7. Returns and Refunds

Our returns policy complies with UK Consumer Rights Act 2015 and Distance Selling Regulations. Consumer customers have the right to cancel an order within 14 calendar days of receiving the goods, except where the goods are custom-made or have been used beyond testing purposes.

7.1 Cancellation Rights

To exercise your right to cancel, you must notify us in writing within 14 days of receiving the goods. You must return items in original condition with all packaging and documentation. Returned goods must be unused or used only for inspection purposes. The cost of return shipping is your responsibility unless the return is due to our error or defective goods.

7.2 Refund Processing

Once we receive and verify returned goods, we will process a refund within 30 days. Refunds are issued to the original payment method. We may deduct reasonable costs for wear and tear beyond normal inspection, or for use outside testing purposes.

7.3 Non-Refundable Items

Custom-manufactured equipment, items damaged through misuse, and goods where more than 14 days have elapsed since delivery are not eligible for refund. Business customers may have different terms as agreed in writing.

8. Warranties

We provide warranty coverage on all products in accordance with the manufacturer's specifications and UK law. Standard warranty covers manufacturing defects and faulty components from the date of delivery.

8.1 Warranty Exclusions

Warranty does not cover:

  • Damage caused by misuse, neglect, or accident;
  • Normal wear and tear;
  • Damage from improper storage or environmental conditions;
  • Unauthorised repairs or modifications;
  • Damage from failure to follow maintenance instructions;
  • Commercial use beyond specified capacity or frequency.

8.2 Warranty Claims

To claim warranty, contact us with photographic evidence and proof of purchase. Warranty claims must be submitted within 30 days of discovering the defect. We reserve the right to repair or replace defective items at our discretion.

9. Limitation of Liability

To the fullest extent permitted by law, Flexstorewn Equipment Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, or business interruption, arising from or related to your use of our products or services, even if we have been advised of the possibility of such damages.

9.1 Maximum Liability

Our total liability for any claim arising from these Terms shall not exceed the purchase price of the product at issue. For consumers, nothing in these Terms limits liability for death, personal injury, fraud, or statutory rights that cannot be excluded.

10. Installation and Safety

Professional installation services are available at additional cost. Installation must be performed by qualified technicians. We assume no responsibility for improper installation by third parties. All equipment must be installed in accordance with manufacturer guidelines and local safety regulations. Proper maintenance and regular safety checks are the responsibility of the equipment owner.

11. Use of Equipment

All fitness equipment carries inherent risks of injury. Users assume all risks associated with equipment use. We recommend proper training and supervision, particularly in commercial settings. Equipment must be used only as intended and within specified weight and usage limits. Failure to follow safety guidelines may void warranty and result in liability.

15. Third-Party Links

Our website may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of external sites. Your use of third-party sites is governed by their terms and privacy policies. We do not endorse any third-party products or services.

Continued use of our services following changes constitutes acceptance of revised Terms. We recommend reviewing these Terms periodically. For significant changes, we may provide additional notice.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales without regard to conflicts of law principles. Both parties irrevocably submit to the exclusive jurisdiction of the courts of England and Wales. You agree to resolve disputes through these courts rather than through arbitration or alternative dispute resolution, except where prohibited by law.

19. Dispute Resolution

Before initiating legal proceedings, we encourage good-faith resolution. If a dispute arises, please contact us to attempt to resolve the matter amicably. If informal resolution fails, either party may seek legal remedies through the courts of England and Wales.

20. Severability

If any provision of these Terms is found invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid, or if not possible, severed. Remaining provisions continue in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy and any other documents referenced herein, constitute the entire agreement between you and Flexstorewn Equipment Ltd concerning the subject matter and supersede all prior negotiations, understandings, and agreements, whether written or oral.
